Welcome to AusLankaServices. These Terms of Service ("Terms") govern your use of our website at auslankaservices.com and all related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

AusLankaServices is an online marketplace connecting Sri Lankan service providers with customers in Australia. Our Services include:

• Classified advertisements for services, jobs, property, events, and more
• User profiles and business listings
• Messaging between users
• Review and rating systems
• Premium listing features
• Community support for Mission BrightStart

3. User Accounts

3.1 Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3.3 Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you meet this age requirement.

4. User Content and Listings

4.1 Your Content

You retain ownership of any content you post on our Services ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content in connection with operating the Services.

4.2 Content Standards

You agree that all User Content you post will:

• Be accurate and not misleading
• Not infringe any intellectual property rights
• Not contain illegal, harmful, or offensive material
• Not contain spam or unauthorized commercial content
• Comply with all applicable laws and regulations

4.3 Prohibited Content

You may not post content that:

• Promotes illegal activities or violence
• Contains hate speech, discrimination, or harassment
• Violates privacy or personal rights
• Contains viruses or malicious code
• Is sexually explicit or pornographic

4.4 Content Moderation

5. Fees and Payments

5.1 Free and Premium Services

Basic listing services are free. Premium features (featured listings, premium placement, extended visibility) require payment. All fees are displayed before purchase and are charged in Australian Dollars (AUD).

5.2 Payment Processing

Payments are processed securely through Stripe. You agree to pay all fees associated with your premium purchases. All sales are final unless otherwise required by law.

5.3 Refunds

Refunds are provided at our discretion. If your listing is rejected during moderation, you will receive a full refund. Otherwise, all sales are final.

5.4 Mission BrightStart Contribution

5% of our profits support Mission BrightStart, providing education for underprivileged students in Sri Lanka. This contribution is included in our operational costs, not added to your fees.

6. User Conduct

You agree not to:

• Use the Services for any unlawful purpose
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Services
• Use automated systems (bots, scrapers) without permission
• Collect user information without consent
• Post fraudulent or deceptive listings
• Manipulate reviews or ratings

7. Intellectual Property

7.1 Our Rights

The Services and all content, features, and functionality (excluding User Content) are owned by AusLankaServices and are protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. You may not modify, reproduce, or distribute any part of the Services without our written permission.

7.3 Trademarks

"AusLankaServices," "AusLanka," and all related logos are trademarks of AusLankaServices. You may not use these marks without our prior written consent.

8. Third-Party Services

Our Services may contain links to third-party websites or integrate with third-party services (Google OAuth, Stripe, etc.). We are not responsible for the content, privacy policies, or practices of third parties. Your use of third-party services is at your own risk.

9. Disclaimers

9.1 No Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9.2 No Endorsement

We do not endorse, verify, or guarantee any listings, services, or users on our platform. We are not responsible for the quality, safety, or legality of services offered through the platform.

9.3 User Responsibility

You are solely responsible for evaluating service providers, verifying credentials, and ensuring transactions comply with applicable laws. We recommend conducting due diligence before engaging with any service provider.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUSLANKASERVICES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR AUD $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless AusLankaServices and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Services, your User Content, or your violation of these Terms.

12. Termination

12.1 By You

You may terminate your account at any time by contacting us or using the account deletion feature. Upon termination, your right to use the Services will cease immediately.

12.2 By Us

We may suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms. We reserve the right to refuse service to anyone.

12.3 Effect of Termination

Upon termination, all licenses granted to you will terminate, and you must cease all use of the Services. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and dispute resolution) will survive.

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of Australia, without regard to conflict of law principles.

13.2 Disputes Between Users

Disputes between users should be resolved directly between the parties. We are not obligated to mediate or resolve disputes but may assist at our discretion.

13.3 Arbitration

Any disputes arising from these Terms or the Services will be resolved through binding arbitration in accordance with Australian arbitration laws, except where prohibited by law.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and AusLankaServices regarding the Services.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Services after changes become effective constitutes acceptance of the new Terms.
